These Terms & Conditions ("Terms") govern your use of the BiMarket UK website at bimarket.co.uk ("Site") and any purchase of goods from us. By placing an order, registering an account or using the Site, you agree to these Terms. Please read them carefully and save a copy for your records. If you do not agree, please do not use the Site.
1. About us
BiMarket UK ("BiMarket", "we", "us", "our") operates the Site and supplies groceries to consumers in Great Britain. You can contact us at [email protected].
2. Definitions
- "You" / "Customer": the person placing an order or using the Site.
- "Goods" / "Products": the items offered for sale on the Site.
- "Order": your offer to buy Goods.
- "Contract": the legally binding agreement formed when we accept your Order (see Section 5).
- "Working day": Monday to Friday, excluding English bank and public holidays.
3. Eligibility and account
- You must be at least 18 years old and resident in Great Britain to place an order.
- You are responsible for keeping your account credentials confidential. You are liable for all activity carried out under your account unless you notify us promptly of unauthorised access.
- You agree to provide accurate, current and complete information and to update it promptly when it changes.
- We may suspend or terminate your account, with or without notice, if we suspect fraud, abuse, breach of these Terms, or if we are required to do so by law.
4. Using the Site
- You may use the Site only for lawful personal, non-commercial purposes.
- You must not attempt to gain unauthorised access, introduce malware, scrape, copy or reverse engineer the Site, place fraudulent orders, or interfere with the service.
- We may modify, suspend or withdraw any part of the Site at any time without liability.
- While we take care to ensure information on the Site is accurate, we do not warrant that descriptions, images, pricing, stock or other content are error-free. We reserve the right to correct errors and to update content without notice.
5. Orders and contract formation
- Placing an order is an offer to buy Goods. An automatic order acknowledgement is not acceptance.
- A Contract is formed only when we send you a dispatch confirmation email for the relevant Goods. We may decline any order (in whole or in part) at our reasonable discretion, including for stock unavailability, suspected fraud, pricing or product description errors, delivery-area restrictions, or breach of these Terms.
- If we cannot fulfil all items in your order, we will inform you and refund the unfulfilled portion.
- Quantity limits may apply to certain products to ensure fair availability for all customers.
6. Prices and VAT
- Prices shown on the Site are in pounds sterling (GBP) and include VAT at the applicable rate where due.
- Delivery charges, where applicable, are shown at checkout before you confirm the order.
- Despite our best efforts, a small number of products may be mispriced. We are not obliged to provide the product at an incorrect price where the error is obvious and could reasonably have been recognised as a mispricing. We will contact you to confirm whether you wish to proceed at the correct price or cancel.
- Promotions, vouchers and discount codes are subject to additional terms, cannot be combined unless stated, and may be withdrawn at any time.
7. Payment
- Payment is taken at the point of order via our payment provider Stripe. We accept major credit and debit cards as displayed at checkout. We do not store full card details.
- By submitting payment information you confirm that you are authorised to use the payment method and that there are sufficient funds.
- If payment is declined, the Contract will not be formed and your order will not be processed.
- For your security, we may carry out fraud, identity and address verification checks. We may decline orders that fail these checks.
8. Delivery
- We deliver to addresses in Great Britain via our authorised couriers. Delivery times shown are estimates and not guaranteed unless expressly stated.
- You are responsible for providing accurate delivery details. We are not liable for late, failed or misdelivered orders caused by inaccurate or incomplete information you provide.
- If you are not at home, the courier may follow its own safe-place / neighbour-delivery procedures, which form part of the courier contract you accept by selecting that delivery method.
- Full delivery terms, areas, slots and charges are set out in our Delivery Information, which is incorporated into these Terms.
9. Risk and ownership
Risk in the Goods passes to you on delivery (or on first attempted delivery to your stated address). Ownership passes to you when we receive full payment in cleared funds.
10. Your right to cancel (consumer cancellation right)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, where applicable, you have 14 days from the day after delivery to cancel certain online purchases.
Important exceptions: the statutory cancellation right does not apply to:
- Goods that are liable to deteriorate or expire rapidly (fresh, chilled and frozen food, dairy, bakery, fresh produce, meat, fish);
- Goods that are sealed for health or hygiene reasons and have been unsealed after delivery;
- Goods made to your specifications or clearly personalised;
- Sealed audio, video or software once unsealed;
- Other categories permitted by law.

11. Your statutory rights regarding faulty or wrongly described goods
Under the Consumer Rights Act 2015, Goods we supply must be of satisfactory quality, fit for purpose and as described. If Goods are defective, damaged in transit, incorrect or do not match the description, please contact us within a reasonable time (and in any case within 30 days of delivery for short-term rejection rights) at [email protected]. We will arrange a replacement, repair (where applicable) or refund.
For perishable items, please notify us within 24 hours of delivery with photographs and your order number so we can investigate while the issue is fresh.
12. Age-restricted products
Some products are subject to legal age restrictions (e.g. knives, lighters, certain energy drinks). We operate a strict Challenge 25 policy. We may refuse delivery and cancel the order without refund of delivery charges if an adult aged 25 or over with appropriate ID is not available to take delivery. BiMarket does not currently sell alcohol or tobacco products through this Site; where any such restrictions apply they will be clearly marked on the product page.
13. Food information, allergens and storage
- While we provide ingredients, allergens and nutritional information from suppliers as accurately as possible, this information can change. Always check the actual product label before consumption, especially if you have allergies or intolerances.
- Best-before and use-by dates shown online or in marketing are indicative. The actual dates on the product label apply.
- You are responsible for storing the goods appropriately upon receipt. We are not liable for deterioration caused by improper storage after delivery.
14. Intellectual property
All content on the Site — including the BiMarket name, logos, designs, photographs, product descriptions, software and other materials — is owned by or licensed to BiMarket and is protected by UK and international intellectual-property laws. You may not copy, reproduce, republish, distribute, modify or use any content for commercial purposes without our prior written permission. See our Intellectual Property and Brand Protection Policy.
15. Our liability
- Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, breach of statutory rights that cannot be excluded, or any other liability that cannot be excluded under English law.
- Subject to the above, our maximum aggregate liability to you in respect of any Contract (including in contract, tort, statute or otherwise) shall not exceed the price paid by you for the relevant Goods.
- We are not liable for any indirect, incidental, special or consequential loss, loss of profit, loss of business, loss of opportunity, loss of goodwill or loss of data arising out of or in connection with the Contract.
- We are not liable for delays or failures to perform our obligations caused by events outside our reasonable control (see Section 17).
16. Indemnity
You agree to indemnify and hold BiMarket harmless from and against all claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.
17. Events beyond our control (force majeure)
We are not responsible for delays or failures in performance caused by events beyond our reasonable control, including but not limited to extreme weather, fire, flood, power or communications failure, epidemic or pandemic, civil unrest, war, terrorism, government restrictions, industrial action, or failure of supplier or courier networks. Where such an event occurs, we will contact you as soon as reasonably possible and our obligations will be suspended for the duration of the event.
18. Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect and use your personal data.
19. Changes to these Terms
We may revise these Terms from time to time. The version in force at the time you place an order is the version that applies to your Contract. We recommend you re-read these Terms before each order.
20. Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.
21. Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign or transfer our rights and obligations to a third party (including in connection with a sale or restructuring of our business), and we will give you reasonable notice if we do so.
22. Governing law and jurisdiction
These Terms and any Contract formed under them are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales, save that consumers may bring proceedings in the courts of the part of the United Kingdom in which they are resident.
