Results & Implementation of Our Policies

This document explains how the policies, terms and notices published on bimarket.co.uk are interpreted, applied and enforced. It should be read alongside our Terms & Conditions and other published policies.
1. Binding effect
By using bimarket.co.uk, creating an account or placing an order, you agree to be bound by the policies and terms in force at the relevant time, including but not limited to the Terms & Conditions, Privacy Policy, Delivery Information, Return Policy, Corporate Protection Policy, Communication & Conduct Policy, Technical Issues Policy, Intellectual Property Policy and Environmental & Social Responsibility Policy.
2. Interpretation
- Headings are for convenience only and do not affect interpretation.
- Examples introduced by "including", "in particular" or similar words are illustrative and do not limit the generality of the words preceding them.
- References to legislation are to that legislation as amended, extended, consolidated or re-enacted from time to time.
- References to "we", "us" or "our" mean BiMarket UK; references to "you" or "your" mean the user concerned.
- Where there is a conflict between policies, the more specific provision applies in the relevant context; subject always to consumers' statutory rights.
3. Severability
If any provision (or part of a provision) of our policies is held by a court or competent authority to be invalid, unenforceable or illegal, the other provisions shall remain in force. If any invalid, unenforceable or illegal provision would be valid, enforceable or legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it valid, enforceable and legal.
4. Waiver
No failure or delay by us in exercising any right or remedy under these policies shall constitute a waiver of that right or remedy. A waiver of any right or remedy shall be effective only if given in writing and shall not be deemed to be a waiver of any subsequent breach or default.
5. Survival of obligations
Provisions that by their nature should survive termination of your account or completion of a Contract will continue in effect, including (without limitation) provisions concerning intellectual property, confidentiality, indemnities, limitation of liability, data protection and governing law.
6. Variations
- We may amend our policies from time to time to reflect changes in our service, business practices or applicable law.
- Material changes will be notified to active customers by email or through a prominent notice on the Site.
- Your continued use of the Site after a change is published constitutes acceptance of the updated policy.
- The version in force at the time you place an order or interact with the Site applies to that order or interaction.
7. Enforcement procedures
- Suspected breaches of our policies are reviewed by appropriately trained members of our team.
- Where appropriate, we will contact the user to understand the situation before taking action; however, in cases of serious or repeated breach, threats to safety, fraud or where action is required by law, we may act without prior contact.
- Decisions may include warnings, restrictions on use, suspension or termination of accounts, refusal of future service, refund withholding, reporting to authorities and legal proceedings.
8. Complaints and dispute resolution
If you disagree with an action we have taken or a decision we have made, please email [email protected] within a reasonable time, setting out the facts and any supporting evidence. We will investigate and respond as quickly as we reasonably can. Nothing in our policies removes your right to seek independent advice from Citizens Advice, your local Trading Standards office or to bring proceedings in court.
9. Governing law and jurisdiction
Our policies and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except that consumers may bring proceedings in the courts of the part of the United Kingdom in which they are resident.
