This Policy describes the intellectual property rights in and around bimarket.co.uk, what you may and may not do with our content, and how to report any infringement.
1. Ownership of content
All content available on or via bimarket.co.uk — including the BiMarket name, logo, trade marks, brand identity, site design, layout, look and feel, source code, software, photographs, images, product descriptions, copy, videos, graphics, illustrations, audio, data compilations and metadata — is owned by, or licensed to, BiMarket UK and is protected by UK and international copyright, trade mark, database, and other intellectual property laws.
2. Limited licence to you
Subject to your compliance with our Terms & Conditions, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for the sole purpose of browsing, shopping and managing your account for personal, non-commercial use. No other rights are granted by implication, estoppel or otherwise.
3. Prohibited uses of our content
Without our prior written permission, you must not:
- Copy, reproduce, republish, upload, post, transmit or distribute any content from the Site in any form or by any means;
- Modify, translate, adapt, create derivative works of or reverse engineer our content;
- Use any content for commercial purposes, including for resale, marketing, advertising, training of artificial-intelligence models or in any product or service that competes with ours;
- Use our trade marks, logos or brand elements in connection with any product, service, promotion or website without an express licence;
- Use automated systems to download, scrape, harvest, mine or index our content, including for the purposes of price comparison, market intelligence or AI training;
- Remove or alter any copyright, trade mark, watermark or other proprietary notice on our content.
4. Third-party brands
Product names, brand names, trade marks and logos of third parties shown on the Site belong to their respective owners and are used to identify the goods on sale. Their appearance on the Site does not imply any endorsement of BiMarket by, or affiliation with, those owners.
5. User-generated content
Where you submit reviews, comments, ratings, photographs or other content to the Site:
- You warrant that you own or have all necessary rights in the content and that it does not infringe any third-party rights or applicable law;
- You grant BiMarket a worldwide, perpetual, royalty-free, non-exclusive, transferable and sub-licensable licence to use, host, store, reproduce, modify, publish, display and distribute the content in connection with our service and our marketing;
- We may, but are not obliged to, moderate, edit or remove content that we consider to be in breach of these policies.
6. Reporting infringement
If you believe that any content on bimarket.co.uk infringes your intellectual property rights, please send a written notice to [email protected] including:
- Your name, address and contact details (and those of the rights holder if different);
- A clear description of the work claimed to have been infringed;
- The URL(s) of the allegedly infringing content;
- A statement that you have a good-faith belief that the use is not authorised;
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the rights holder;
- Your physical or electronic signature.
We will investigate genuine notices promptly and take such action as we consider appropriate.
7. Counterfeit or imitation goods
We do not knowingly sell counterfeit goods. If you suspect any product offered on bimarket.co.uk to be counterfeit or to infringe a third-party trade mark, please contact us at the address above with supporting evidence.
8. Brand protection and enforcement
We actively monitor for unauthorised use of our brand and content and reserve all rights to take enforcement action, including but not limited to issuing take-down notices, reporting infringement to platforms and registrars, and pursuing civil or criminal proceedings.
